Title 8, sec. 1325.

"Section 1325 sets forth criminal offenses relating to (1) improper entry into the United States by an alien, (2) entry into marriage for the purpose of evading immigration laws, and (3) establishing a commercial enterprise for the purpose of evading immigration laws. The Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) amended 8 U.S.C. § 1325 to provide that an alien apprehended while entering or attempting to enter the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty.

 

Comment: Further discussion of these offenses is set forth in Chapter 4 of Immigration Law, published as part of the Office of Legal Education's Litigation Series, and as part of the USABook computer library."

Title 8, sec. 1325.

 

This title covers illegal entry, it has nothing to do with over staying a visa. 

 

Having a visa is the granted permission from the US government to be in the U.S. for a specific duration of time and for a specific purpose.  Essentially it's a "free pass" to be in the US and enjoy all the benefits our country is willing to extend to you during your stay in the U.S.  They can be renewed or revoked as the government sees fit.

 

Over staying a visa is viewed as a civil offense, not a criminal offense, meaning you broke a rule or regulation but not necessarily a law.  Therefore Pelosi's argument, while based in semantics, is factual.

It's not a civil offense it's a civil infraction ,, but yeah..  Have any of you ever been to court over a "civil infraction"  .. and i mean a real one,  not a traffic ticket one??  I wouldn't walk i there without a lawyer,,,,,,,,,,,, coals,,,,,,,,, they will rake you over them.

United  States,  unless  (A)  prior  to  his  reembarkation  at  a  place 
outside  the  United  States  or  his  application  for  admission   from  
foreign  contiguous  territory,  the  Attorney  General  has  expressly 
consented  to  such  alien's  reapplying  for  admission;  or  ( B)  with 
respect  to  an  alien  previously  excluded  and  deported,  unless  such 
alien shall establish that he was not required to obtain such  advance 
consent under this or any prior  Act, 
shall  be  guilty  of  a  felonyand  upon  conviction

Still worth pointing out that, to my knowledge, there is no law against being in the U.S. Entering without permission can be illegal. But being here is not. Thus no law was necessarily broken. Like cigarettes. You can't buy them under age, but having them is legal (federally). States may differ.

..you saying that a person who crossed the border from Mexico w out a passport or visa are not breaking any laws?

So what law is broken by being in the U.S. without a Visa or citizenship?  

Maybe an immigration law ? with your logic i guess you could get pulled over for speeding and then tell the officer "but i'm not speeding now because you pulled me over,therefore i'm guilty of no crime"

...generalizations..I'm certain that there are some that take their jobs seriously at 7-11.

I'm talking about hard work.A guy that digs a trench with a shovel a tree trimmer,concrete finisher etc.Standing at a cash register is not hard work.I could never do it.

My step sister works night shift at a 7-11. I wouldn't wish it on my worst enemy. She routinely has to clean shit off the walls of the bathroom and deal with mentally ill people wandering into the store. You couldn't pay me enough to stand behind that counter and deal with the lowest of the low.

A better example would be showing up to a party, the host mentions speaking with you an hour ago when you were leaving the house. A cop who was nearby writes you a ticket because he thinks you must have been speeding to get there in an hour.

To me that's a shitty job.The 7-11's up there have public bathrooms ?
