Man who shot Texas church gunman shares his story

SUTHERLAND SPRINGS, Texas —

Stephen Willeford shot and chased the man who killed 26 people in a Texas church on Sunday. He spoke to 40/29 News in an exclusive sit-down interview on Monday.

 

Willeford was at home when his daughter came into his bedroom to tell him she heard gunshots at the First Baptist Church nearby.

 

Willeford, a former NRA instructor, got his rifle out of his safe while his daughter looked outside again. She ran back in and told him she saw a man in black tactical gear shooting up the church.

So Willeford was the 'other gunman', he was 'armed', he and the suspect shot at each other. Got it.

 

It might even come out that having hit the gunman, maybe it was his shots that were fatal. Never know....

DATABASE: Domestic violence case wasn't reported correctly

 

AUSTIN - A mistake by U.S. Air Force officials in reporting Devin Patrick Kelley's past conviction for domestic violence allowed him to buy four guns, including the semi-automatic rifle used in the Sunday shooting at a South Texas church that left 26 dead and 20 others wounded, state and federal officials confirmed Monday.

 

Pentagon officials said if Kelley's 2012 conviction in a military court for assaulting his then-wife and stepson had been reported correctly to a national database, the 26-year-old New Braunfels man would have been denied permission to buy the weapons.

 

Retired Col. Don Christensen, who was the chief prosecutor for the Air Force at the time of Kelley's general court-martial, said that while Kelley's punitive discharge - a bad conduct discharge but not a dishonorable discharge - would not have prohibited him from owning a gun, his sentence to a year's confinement in a military prison would have.

Amen. The biggest "loophole" in the BATF background check system is the BATF's unwillingness to prosecute those who lie on the form, are denied the purchase and then allowed to simply walk away without being detained or even contacted by LEOs.

 

I can't think of any other fed form where when you're caught lying to them they just say, "Oh, we're cool, bro! No harm/no foul!". The system that's designed to keep bad guys from getting guns often stops them from attempting to buy guns but then fails to punish them for lying on the form.

 

The only new law we need is mandatory police or BATF contact of anyone caught lying on the form. It won't stop all the bad actors but it would alert LEOs that someone who is not entitled to own firearms is attempting to purchase one.

The problem with the BATFE is that the fed gets lots of money from the A and the T so they keep a much closer eye on those, have to protect their "constituents".

Yes and no. If you're an F constituent with an FFL (even a non-commercial FFL like a Curio-Relic license) and you have an honest mistake in your bound book (log of all your purchases) they will slam you hard. You will be punished far more for a genuine mistake than a violent felon who was caught intentionally lying on a form. The ATF comes down harder on the accidental violation of a statute than they do a willful attempt at flouting the law.

Actually thanks to our Supreme Court violent felons have a legal right to lie on their applications since if they told the truth they would be testifying against themselves in violation of their 5th amendment rights.
